The president of the Supreme Court and the General Council of the Judiciary, Carlos Lesmes , and the European Prosecutor General, Laura Codruta Kövesi , have signed today a collaboration agreement that will allow European prosecutors to use the Judicial Neutral Point as a tool in the investigation of crimes that affect the financial interests of the Union, the competence of which is attributed to it by Council Regulation (EU) 2017/1939 of October 12, 2017 and Directive (EU) 2017/1371 . The Judicial Neutral Point is a communications network that allows judicial bodies to access information and be connected to other entities, such as public administrations, professional associations, financial entities or registries, with the aim of improving the processing times of matters.
Through the Judicial Neutral Point, judges can access, for example, the databases of the State Tax Administration Agency , the National Institute of Statistics, the General Directorate of Traffic, banks and savings Phone Number Data banks. European Attorney General, Laura Codruta Kövesi (Photo: Google) With the signing of this agreement, a channel of collaboration is established between the CGPJ and the European Public Prosecutor's Office for the latter to obtain, when exercising the functions established by law, the information contained in the databases of the administrations and organizations that make up the Judicial Neutral Point.
Access to information will require the prior existence of a procedural resolution that authorizes the request for information and can only be made by users who have been authorized. The European Public Prosecutor's Office undertakes to ensure the correct use of the communications network , to formulate requests for information only in the exercise of its functions and following a resolution that justifies it, and to not include the data obtained in databases or files that may be consulted by third parties, natural or legal persons. Likewise, the European Public Prosecutor's Office will have the status of independent controller of the processing of personal data to which it has access.
